RECENT SETTLEMENTS
INSURANCE COMPANY HELD LIABLE
FOR BAD FAITH:
Our Client lost his son in a
tragic drowning accident, while boating at a lake. He was sued for
wrongful death by his ex-wife and she won a judgment for $50,000. He had
an insurance policy for his boat but the carrier refused to pay for his lawyer
or pay the judgment because it claimed the accident did not involve the use of
the boat. We were able to successfully argue that the insurance company's
position was not only wrong, but also that it acted in bad faith. Justice
prevailed and the insurance company was forced to pay a $450,000 settlement.
MOTORCYCLE DEALER HELD
RESPONSIBLE FOR DEFECTIVE BIKE:
Our Client was struck by a
motorcycle and suffered serious personal injuries. The motorcycle driver
had just purchased the used bike two hours earlier form a local dealer. He
was told that there was a problem with the brakes but the bike would be
safe to ride until repairs could be made. At the time of the accident, the
driver applied the front brakes but there was no stopping power. During
the litigation, the dealer first claimed that there never was a problem with the
brakes but later admitted that there was a defect and that he even rebuilt the
brakes after the accident. Justice prevailed and our client settled her
case for $365,000.
